Client was charged with domestic assault for allegedly threating to beat up his wife. The two of them were married for over thirty years, and during the midst of a contested divorce proceeding, the wife conveniently accused Mr. K of threatening her. It was a convenient way to force him out of the home.
Convinced that this was a fabrication and a lie, I negotiated hard. With some effort and convincing, I was able to secure Mr. K an offer where the State suspended prosecution for two years on the primary agreement that Mr. K not contact his ex-wife anymore. At the end of two years, the charges will be dismissed.
This deal was arranged on the eve of trial. Sometimes, all it takes is preparing for trial and playing the game of chicken with the State. Oftentimes, someone gets cold feet about trial and the deal sweetens up.
